New Legal Support For Work Capacity Appeal Merit Reviews

Finally, legal support for a Merit review.

After a year of waiting the Government has finally introduced some level of help to injured workers when they apply for a review of their insurers decision to cut them off.

Your Solicitor can now request financial compensation for assisting you to conduct a merit review of a Work Capacity Decision by an insurer.

This is only available if you have applied for an internal review (which their lawyer can not received financial assistance in completing) and had not been successful in that review.

This will be $1,200 per merit review completed with an extra $600 if that review is successful for you.

This applies to new applications for review only (after 16 December 2016)

    If any injured workers have had a work capacity decision made after the 16th of December last year and have received incorrect information in regards to a legal practitioner not able to be paid to review the decision, please, please contact ‘customer Care’ on 13 10 50 and make a complaint.

    I know for a fact that Insurers are sending outdated information to injured workers.

    Please take the time to let the people in charge of the system know that the insurers are not passing information on to injured workers about their rights to legal advice.
