Peter Johnston’s Story. A Workplace Injury is for Life.

imageWhere do I start?

Well my Name is Peter and I was injured in 2007, I was a Track rider/stable hand I was working 45-50 hours per week before I had the accident.

I was rider track work at Griffith Racecourse when the horse I was on bucked me off causing me to land in front of it, as it went over the top of me it stood on my left ankle, breaking a number of bones. As I attempted to get up I noticed the trainer had left, so I was lying there for a long period of time before I could wave someone down to help.
I was then rushed to the local hospital where they put a plaster cast on my ankle and explaining to me that I would have to go to Wagga base hospital to have surgery. 3 days later I had the surgery on my ankle (plates and screws) 3 months after they removed the screws due to complications.

As my ankle got worse I had been sent to Sydney to see a top ankle surgeon who then requested I have further surgery on my ankle to help ease the pain. Not too long after that surgery I had further issues resulting in me having my left ankle fussed in 2009.

Around about 8 months later there was me issues resulting in me have more surgery to remove screws as they were popping through my skin.
In early 2011 I started having issues with my left hip, my local GP requested I see a hip surgeon as he thought that with all the issues related to my ankle had led to my hip to play up, I seen that surgeon who sent me on to a top surgeon in Canberra, he requested I have a hip arthroscope done, the insurance company accepted the liability of this and paid for that operation in 2012. 3 months after I was still having issues with my hip and the pain was getting worse, my surgeon requested further scans and also requested further surgery, that was denied by the insurance company and they sent me to one of the IME doctors in 2013 in that doctors report he stated that my left hip issues I was born with and said it was not the insurance company who should not be paying for. As from that date my life got worse as I was sent to doctor after doctor after doctor who all have stated in there reports that my hip issues were related to my initial injury. The insurance company then sent me a work capacity assessment stating that my wages and medical expenses were going to cease. I disputed every single thing that had sent me but I was not going anywhere, I was losing every fight. I then hit my rock bottom and attempted suicide in 2014.

After this the insurance company sent me to a psychiatrist in Canberra some 4 hours away. I requested the insurance company pay for accommodation as I was not in the best frame of mind to drive such a long distance in one day, as I thought they would they denied that request and pretty much forced me to drive all that way and back in one day. That appointment went for no longer then 10min. Not once did that doctor ask about my injury or the issues related to it. So by now you would have thought I would give up on this system, but I didn’t I fought and fought until last week I got a result that isn’t my main gain but it is something and that is the insurance company will pay for my hip operation that was requested back in late 2012. I still have a long way to go in to getting what is right and that is to have them pay for my future medical expenses not just for my initial injury but also my hip. As I know I did not fit the required WPI of 21% I was assessed at 17% back in 2010 and what you can see my injury has not got any better it’s getting worse every day. I was advised I could go for further WPI assessment if my injury got worse and my entire medical was covered for the rest of my life.
These people in the government of NSW think they have done a good thing by all, but they haven’t, they have made my life a living hell since 2012.
I have been forced to go back to some kind of work, even though my injuries are getting worse as time goes by. I will keep fighting until I receive what is my right of an injured worker and that is to be re assessed for WPI with my left ankle and left hip included as this is what should have been done before they were able to do what they have done.

I’ve started the petition “GOVERNMENT OF NSW: Workers compensation NSW Legislation Whole Person Impairment % (deterioration) and medical expenses” I need your help to get it off the ground.
Will you take 30 seconds to sign it right now?
